The Canadian province of Alberta has brought a vape law that bans minors from purchasing e-cigarettes whereas allowing flavored product sales. After the introduction of the amended Tobacco and Smoking Reduction Act, Alberta Health Minister Tyler Shandro said that flavored vaping products was not banned yet, but might be added: “down the road”. She added, “Strong action needs to be taken to address significant increases in youth vaping”, and introduced Bill 19.

This bill follows a report that included vaping data gathered from over 75,000 students in Grades 9 to 12 in B.C., Alberta, Ontario, and Quebec released last December, and it indicated an important increase in teen vaping among high school students. According to this report, almost one-third of all high school students in Alberta and Quebec, and one in four in Ontario said that they had used vaping products in the past month.

For this reason, Bill 19 has banned minors from buying vape products and imposes harsh penalties on violators. An article on The Province is referring to Bill 19, as striking the right balance. “Bill 19 aims to amend the Tobacco and Smoking Reduction Act to include new restrictions and regulations for vaping products, specifically around where and how they can be sold and used.”

The bill gives the province the authority to consider such restrictions in the future but holds off doing so for now.”

“A study published earlier this month by researchers at the Yale School of Public Health found that smokers who switched to flavored vaping products were more than twice as likely to quit cigarettes compared to those who used tobacco-flavored vaping products.”

“In other words, the lack of a ban on flavored vaping products does not render Bill 19 a failure or useless. It’s actually quite in keeping with the intent of striking a reasonable balance.”

Last week, the Georgia Senate voted to impose a 7% tax on vaping products and raise the age limit to purchase both tobacco and vaping products from 18 to 21. The researchers examined the data from 35,000 national retailers between 2011 and 2017 and found that for every 10% increase in e-cigarette prices, e-cigarette sales dropped by 26%. However, the same 10% increase in e-cigarette prices caused an 11% increase in traditional cigarette sales. This means that vaping products help people quit traditional cigarettes and banning vaping or any increase in e-cigarette prices will be increasing the number of smokers.

“We estimate that for every e-cigarette pod no longer purchased as a result of an e-cigarette tax, 6.2 extra packs of cigarettes are purchased instead,” said concerned study co-author and economist from Georgia State University Michael Pesko.

The final stages of the Smokefree Environments and Regulated Products (Vaping) Amendment Bill will be debated in the next few days after the House maintains for its final three-week session before the General Election. AVCA co-director and executive coordinator of the Coalition of Asia Pacific Tobacco Harm Reduction Advocates (CAPHRA) Nancy Loucas, referred to a bill amendment offered by MP Wagner, which recommends lifting the local snus ban. She said that Wagner has listened to the submissions made by harm reduction experts and that his suggestion should be supported.

Loucas said “MP Nicky Wagner’s amendment to reverse the Government’s effective ban on oral tobacco-free nicotine pouches deserves supporting. Thank goodness at least one MP read and listened to key submissions and evidence on the bill to regulate vaping,” and she added, “As the amendment on pouches notes, the Ministry of Health advised the Health Select Committee that oral nicotine products are significantly less harmful than smoking. Given they’re administered orally there are no adverse health problems that have been proven through nicotine gum and sprays. Hence, banning them makes absolutely no sense.” 

Wagner has proposed two Supplementary Order Papers (SOPs) one that lifts the ban of oral tobacco-free nicotine pouches and another that allows businesses that receive at least 50% (not 70%) of their turnover from vaping products, in order to be allowed the specialist vape retailer status. 

Lucas explained “More specialist retailers mean better access to vape flavors for Kiwis keen to quit smoking. It’s crazy that general retailers will only be permitted to sell mint, menthol and tobacco flavors whilst allowing combustible tobacco to be sold freely. Allowing for more specialist vape retailers, under strict conditions, would only be a positive for Smokefree 2025.”

Loucas has stated that rather than rushing the bill in the last few days leading to the local General Election, the bill’s complexities should be discussed in the coming days. She said “We’ve been calling for legislation for years, and to think it could now be rushed through under Urgency is completely unacceptable. Sadly, the only winners will be the shareholders of multinational corporations.”

The researchers had conducted telephone interviews with 22 customers who were recruited in vape shops in the East Midlands region of England and analyzed the smoking histories of the participants, the reasons why they were using e-cigarettes, the role of vape shops in their e-cigarettes use, and if smoking cessation was discussed in vape shops or not.

The results of this study had indicated that the participants regarded e-cigarettes as a tool for quitting smoking and shown very positive experiences of vaping. In addition to this, the participants said that vape shops play a key role in their positive experiences since vape shops provided access to a large variety of high-quality and safer products and reliable information and advice of these products for them.

All of this information and studies point out one specific thing. Safer products such as e-cigarettes are the products that people tend to use when they quit smoking.
